About PAIA and this manual
The Promotion of Access to Information Act, 2000 (PAIA) gives effect to the constitutional right of access to information in section 32 of the Constitution. A requester must be given access to a record held by a private body such as Arke Technologies if the record is required to exercise or protect a right, the request follows the procedure the Act prescribes, and no ground for refusal in the Act applies (section 50).
Section 51 of PAIA, as amended by the Protection of Personal Information Act, 2013 (POPIA), requires a private body to publish a manual that helps requesters find and ask for its records. This page sets out our manual in summary, and the full manual is available on request from our Information Officer. We review the manual regularly and update it when our records or our processing change.

Organisations preparing their own PAIA manual and POPIA controls can start with our POPIA compliance checklist.
How to request access to a record
01.
Complete Form 2, the request for access to a record in the PAIA Regulations, 2021. It is available from the Information Regulator's website or from our Information Officer.
02.
Send it to our Information Officer at info@arketechnologies.com, or deliver it to our head office.
03.
Give the detail the Act requires (section 53): enough to identify the record and you, the form of access you want, your contact details, the right you want to exercise or protect and why you need the record for it, and proof of your authority if you act for someone else.
04.
Pay the request fee if it applies
We tell you in writing if a fee is payable; a personal requester, asking for records about themselves, pays none.
05.
Receive our decision within 30 days after we receive the request (section 56). We may extend this once, by up to 30 days, in the circumstances section 57 allows, for example a request for a large number of records, and we tell you why in writing. If we do not decide in time, the Act treats the request as refused (section 58).
06.
Receive access in the form you asked for where that is reasonably possible (section 60), once any access fee is paid.
Fees
The PAIA Regulations, 2021 prescribe the fees, and we ask for nothing beyond them. We tell you in writing what applies before we do any work that carries a fee.
| Fee | Amount (PAIA Regulations, 2021, Annexure B; checked September 2026) |
|---|---|
| Request fee | R140.00; not payable by a personal requester |
| Copies of records | R2.00 an A4 page, printed or photocopied |
| Search and preparation | R145.00 an hour after the first hour, up to R435.00 in total |
| Deposit | Up to one third of the access fee, where the search is expected to take more than six hours |
| Postage, email or other electronic transfer | The actual cost, if any |
You may complain to the Information Regulator about a decision on fees (section 77A).
Grounds for refusal
We refuse access only where PAIA requires or allows it. The grounds include protecting:
the privacy of a third party who is a natural person (section 63);
a third party's commercial information, such as trade secrets or information supplied in confidence (section 64);
confidential information of a third party, where disclosure would breach a duty of confidence owed under an agreement (section 65);
the safety of individuals and the security of property, including a computer or communication system (section 66);
records privileged from production in legal proceedings (section 67);
our own commercial information, such as trade secrets, financial or technical information whose disclosure would harm us, and computer programs we own (section 68);
research information of a third party or of Arke Technologies (section 69).
We must still grant access where a record would reveal evidence of a substantial contravention of the law, or of an imminent and serious risk to public safety or the environment, and the public interest clearly outweighs the harm (section 70). Where only part of a record is protected, we release the rest (section 59). If a record contains a third party's information, we notify that party and consider its representations before we decide (sections 71 to 73).
If you disagree with our decision
PAIA provides no internal appeal against a private body. If we refuse your request, or you disagree with our decision on fees, an extension or the form of access, you may complain to the Information Regulator within 180 days of the decision (section 77A), using the Regulator's complaint form (Form 5 of the PAIA Regulations, 2021). You may instead apply to a court within 180 days (section 78); the Regulator's guide advises considering a complaint to the Regulator first, and you cannot apply to a court while a complaint to the Regulator is still pending.

Frequently asked questions
What is a PAIA manual? Show answer Hide answer
A PAIA manual is the document that section 51 of the Promotion of Access to Information Act, 2000 requires a private body to publish. It describes the records the body holds, how to request them, the fees and the grounds for refusal, and how the body processes personal information, so that anyone exercising a right of access knows where to start.
Who can request a record from Arke Technologies under PAIA? Show answer Hide answer
Anyone can, if the record is required to exercise or protect a right, the request follows the procedure the Act prescribes, and no ground for refusal applies (section 50). You do not need to be a client. Requests for your own personal information are personal requests and carry no request fee. Send Form 2 to our Information Officer at info@arketechnologies.com.
How long does Arke Technologies have to decide on a PAIA request? Show answer Hide answer
We must decide within 30 days after we receive the request (section 56 of PAIA). We may extend that period once, by up to 30 days, where the Act allows it, for example for a request covering a large number of records, and we tell you the reason in writing. If we miss the deadline, the Act treats the request as refused.
What does a PAIA request to Arke Technologies cost? Show answer Hide answer
The request fee prescribed for private bodies is R140.00, and personal requesters seeking their own information pay none. Access fees then cover copies, at R2.00 a page, and search and preparation beyond the first hour, capped at R435.00 (PAIA Regulations, 2021; checked September 2026). We tell you in writing what applies before we do the work.
Can Arke Technologies refuse a PAIA request? Show answer Hide answer
Yes, but only on the grounds PAIA sets out, such as protecting a third party's personal or commercial information, privileged records, the security of a computer system, or our trade secrets. We release any part of a record that is not protected, and the public-interest override in section 70 can require disclosure. You can complain to the Information Regulator about any refusal.
What is the difference between a PAIA request and a POPIA request? Show answer Hide answer
A POPIA request concerns your own personal information: you can ask us to confirm, free of charge, whether we hold it, and ask us to correct or delete it. A PAIA request asks for access to a record, which may or may not be about you, and follows the Form 2 procedure. A copy of your own records is requested through PAIA, without a request fee.
