Who we are and what this notice covers
The responsible party for your personal information is Arke Technologies (Pty) Ltd, registration number 2017/386810/07, whose head office is at 8 Greenstone Place, Stoneridge Office Park, Block A North, First Floor, Greenstone Hill, Johannesburg, 1609, South Africa. Until 28 September 2026 the company was registered as Fibre Boyz (Pty) Ltd; the change of name did not change the legal entity, so information you gave us under that name is held by the same company and covered by this notice.
This notice applies when you visit arketechnologies.com, contact us, become a client, supply goods or services to us, apply for a job or receive our newsletter. Server Hub, our IT hardware division, and Fibre Boyz, our connectivity division, are part of the same company; where their websites publish a notice for a particular service, that notice adds to this one. Our registration, VAT and B-BBEE details are on our company facts page.
POPIA protects information about identifiable, living people and, where it applies, existing organisations. We use "personal information" in that sense throughout this notice.
The personal information we collect
We collect only what a stated purpose needs. Most of it comes from you directly; some comes from your organisation when it engages us, or from public records such as company registration details.
| Who you are | What we collect | Where it comes from |
|---|---|---|
| Website visitor | IP address, browser and device type, pages visited and your cookie choices; see our cookie notice | Your browser, through essential cookies and, if you allow them, analytics cookies |
| Enquirer, or someone asking for a demo or early access | Name, organisation, role, work email address, telephone number, country, the type and size of your organisation, what your enquiry is about, any tender or decision deadline, and your message | Our contact, demo and early-access forms, email, telephone calls and meetings |
| Contact or user at a client organisation | Work contact details, job role, user names, account and device details, monitoring data from managed devices, support tickets and correspondence | You, your organisation and the systems we manage for it |
| Billing contact | Company details, VAT number, purchase orders and the bank details needed for debit orders | Your organisation |
| Connectivity customer | Name, service address, and contact, account and billing details | You, when you order from Fibre Boyz |
| Supplier or service provider | Contact details of your people, company documents and bank details for payment | Your organisation |
| Job applicant | CV, qualifications, certifications, work history and references | You, and the referees you name |
| Newsletter subscriber | Email address, your first name if you give it, the topics you choose and your marketing choices | You |
Giving us personal information is voluntary, except where a law or a contract requires it, for example the details a tax invoice must carry. If you do not provide what we need, we may not be able to respond to you or deliver a service.
Special personal information. We do not ask for special personal information, such as health, religious or biometric information, unless we need it and the law permits it (for example, employment-equity information about employees) or you have consented.
Children. This website is written for organisations, not for children, and we do not knowingly collect children's personal information through it. When we run systems for a school that hold learners' information, the school, or the body that runs it, remains the responsible party and we act as its operator, as described below.
Why we use it, and the lawful basis
POPIA allows processing only on a lawful ground listed in section 11. This table sets out each purpose and the ground we rely on.
| Purpose | Lawful ground (POPIA section 11) |
|---|---|
| Responding to enquiries, demo and early-access requests, and preparing proposals, quotes and tender responses | Your consent when you submit one of our forms, our legitimate interest in answering you, or steps you ask for before a contract |
| Delivering contracted services: managed IT, cybersecurity, software, integration, AI, cloud, hardware and connectivity | Performance of a contract, and our and our client's legitimate interests |
| Securing our systems and those we manage, including approving and logging remote sessions | Our legal duty to secure personal information (section 19) and our legitimate interests |
| Invoicing, debit orders, accounting and tax | Performance of a contract, and compliance with tax and company law |
| Recruitment | Steps you ask for before an employment contract, and your consent before we contact referees |
| Newsletters, product news, early-access updates and news about services similar to those you use | Your consent or, if you are a client, the customer exception in section 69(3) of POPIA, with an opt-out in every message |
| Measuring and improving this website | Your consent to analytics cookies |
| Meeting legal duties and protecting our rights, including requests from regulators and courts | Compliance with the law and our legitimate interests |
Where we rely on your consent, you may withdraw it at any time; withdrawal does not affect processing that took place before it. Where we rely on a legitimate interest, you may object on reasonable grounds (section 11(3)), and we stop unless legislation provides for the processing.
When we act for your organisation
When we manage IT, security or software for an organisation, that organisation is the responsible party for the personal information in its systems, and we act as its operator under sections 20 and 21 of POPIA. In practice:
We process the information only on the organisation's instructions, under a written agreement that requires confidentiality and security safeguards.
Every remote session is approved and logged, and everyone with access to client systems is bound by confidentiality and our security controls.
We notify the organisation immediately if we have reasonable grounds to believe that its personal information has been accessed or acquired by an unauthorised person, so that it can meet its own duties.
We never train AI models on client data without the client's explicit consent.
The organisation owns its data, credentials and documentation, and we hand them back in order when an engagement ends.
If your personal information sits in a system we manage for your employer, your school or another organisation, send your request to that organisation; we help it respond. Organisations that want support with their own obligations can read about our POPIA compliance service.
Who we share it with
We share personal information only where a purpose in this notice requires it, and only as much as that purpose needs. We do not sell or rent personal information. Recipients fall into these categories:
Our team, on a need-to-know basis and bound by confidentiality.
Service providers that process information for us, such as cloud hosting, email, accounting and payroll systems, under written agreements that require confidentiality and security safeguards.
Banks and payment service providers, to collect payments and debit orders.
Network operators, when you order connectivity from Fibre Boyz, so that your service can be connected and activated.
Couriers, when we deliver equipment you ordered.
Software and cloud vendors, when we register licences, subscriptions or support cases in your organisation's name.
Professional advisers, such as accountants, auditors and attorneys, who owe us a duty of confidentiality.
Regulators, courts and law enforcement, where the law requires it, for example the South African Revenue Service or the Information Regulator.
A buyer or successor, if all or part of our business is sold or restructured, under confidentiality and only as far as the transaction requires.
Transfers outside South Africa
Some of the cloud services we use may store or process information outside South Africa. We transfer personal information across borders only where section 72 of POPIA allows it, which means that one of these conditions applies:
The recipient is bound by a law, binding corporate rules or a binding agreement that gives protection substantially similar to POPIA's.
You consent to the transfer.
The transfer is necessary to perform a contract with you, or to take steps you asked for before one.
The transfer is necessary for a contract concluded in your interest between us and a third party.
The transfer is for your benefit, it is not reasonably practicable to obtain your consent, and you would be likely to give it.
How long we keep it
We keep personal information only as long as its purpose requires, unless a law, a contract or your consent requires or allows a longer period (section 14 of POPIA). When the period ends, we delete or destroy the information, or de-identify it so that it no longer identifies you.
| Record | Retention |
|---|---|
| Accounting, tax and VAT records | At least five years from the date the relevant return is submitted, as the Tax Administration Act, 2011 requires |
| Records the Companies Act, 2008 requires us to keep | At least seven years (section 24 of that Act) |
| Client contracts and service records | For the term of the contract, then as long as the law or a possible legal claim requires |
| Employment records | At least three years after the last entry for records kept under the Basic Conditions of Employment Act, 1997, and longer where other laws require |
| Marketing lists | Until you unsubscribe; we then keep your address on a suppression list so that we do not contact you again |
| Enquiries that do not lead to an engagement, unsuccessful job applications and remote-session logs | Only as long as necessary for the purpose for which they were collected, after which they are deleted or anonymised |
| Cookies | As listed in our cookie notice |
How we protect it
Section 19 of POPIA requires appropriate, reasonable technical and organisational measures. Ours include:
Encryption of personal information in transit and at rest.
Access controls that limit information to the people who need it.
Audit logging, including the approval and logging of every remote session on our own remote-access platform, which runs on our own servers in Johannesburg.
Data minimisation: we collect and keep only what a purpose needs.
Confidentiality obligations for everyone with access to personal information.
Written agreements with the service providers that process information for us.
Security controls aligned with ISO/IEC 27001, the NIST Cybersecurity Framework and CIS Controls. We work to these frameworks; we do not hold certification.
If something goes wrong. If we have reasonable grounds to believe that personal information we are responsible for has been accessed or acquired by an unauthorised person, we notify the Information Regulator and the people affected as soon as reasonably possible (section 22), with enough detail for them to protect themselves. Where the information belongs to a client, we notify the client immediately.
Your rights under POPIA
You have the right to:
Be told what personal information we collect about you and why, as this notice sets out (section 18).
Access it: ask us to confirm, free of charge, whether we hold personal information about you, and ask for a copy or description of it, including who has had access to it (section 23).
Correct or delete it where it is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully, or where we are no longer authorised to keep it (section 24).
Object to processing based on a legitimate interest, and to direct marketing at any time (sections 11(3) and 69).
Withdraw consent you have given, at any time.
Not be subject to a decision based solely on automated processing that has legal consequences for you or affects you to a substantial degree (section 71).
Complain to the Information Regulator (section 74), and institute civil proceedings (section 99).
How to exercise your rights
01.
Write to our Information Officer at info@arketechnologies.com, or deliver your request to our head office, saying which right you want to exercise.
02.
Prove your identity
We verify who you are before we disclose or change anything, so that your information never reaches someone else. If you act for another person, include their written authority.
03.
Use the prescribed form where there is one
Objections are made on Form 1, and requests to correct or delete information on Form 2, of the POPIA Regulations, 2018. Our Information Officer can send you the forms and help you complete them.
04.
Ask for copies through PAIA
A request for a copy of your records follows the procedure in our PAIA manual. As a personal requester you pay no request fee; if fees for copies apply, we give you a written estimate first.
05.
Receive our answer within 30 days
For access requests this is the period PAIA sets. The Act allows one extension of up to 30 days in defined circumstances, and we tell you in writing if we need it.
Direct marketing
We send electronic marketing, such as our newsletter, only if you have consented to it or, if you are a client, about services similar to those you have bought from us, as section 69(3) of POPIA allows. Every message identifies us and gives you a free, simple way to opt out.
When you unsubscribe, we record your choice on a suppression list so that you receive no further marketing from us unless you opt back in. Service messages about a contract you hold with us, such as invoices and maintenance notices, are not marketing and continue.
Automated decisions and AI
We use AI in parts of our work, for example to draft replies for staff to approve and to support quoting, under a simple rule: AI recommends and people decide. We do not make decisions about you based solely on automated processing that have legal consequences for you or affect you to a substantial degree. Our AI use disclosure explains where and how we use AI.
Changes to this notice
We update this notice when our processing changes, and the date at the top shows the current version. If a change materially affects how we use your personal information, we tell you on this website and, where we hold your contact details for that purpose, by email. This notice sits alongside our website terms of use.
