POPIA compliance: the framework, the safeguards and the evidence
POPIA compliance means processing personal information lawfully under the Protection of Personal Information Act, and being able to prove it. Arke Technologies, in Johannesburg, helps organisations, public bodies and schools across South Africa build the compliance framework, secure the systems that hold personal information and keep the evidence the Information Regulator expects.
What POPIA compliance means
The meaning of POPIA compliance is simple to state and demanding to deliver: every record you hold about a person, whether customer, learner, patient, citizen, supplier or employee, is collected for a defined purpose, kept no longer than necessary, protected by reasonable safeguards and open to the person it describes. The POPI Act (the Protection of Personal Information Act 4 of 2013) sets eight conditions for lawful processing, which the Information Regulator enforces alongside the Promotion of Access to Information Act (PAIA).
Being POPI Act compliant is a state you maintain, not a certificate you frame: a framework that governs the work, systems that protect the information and records that prove both.
Full compliance with the requirements of POPIA was required by 30 June 2021, when the one-year grace period after most of the Act took effect on 1 July 2020 ended, so there is no later POPIA compliance date or deadline to wait for. POPIA compliance sits within our cybersecurity services, because section 19, the security condition, is met largely in your systems.

Who is responsible for POPIA compliance
The organisation itself, as the responsible party, is accountable, and POPIA assigns duties to four parties in all:
| Party | Role under POPIA | Duties |
|---|---|---|
| Responsible party (your organisation) | Decides why and how personal information is processed | Meets all eight conditions and can show that it does (section 8) |
| Information Officer and deputies | By default the head of the organisation: the chief executive or equivalent in a company, the municipal manager in a municipality | Registered with the Regulator; maintains the compliance framework, handles requests and runs awareness sessions |
| Operators | Payroll bureaux, cloud providers and IT companies that process information on your behalf | A written contract, security measures and immediate notice of any compromise (sections 20 and 21) |
| Information Regulator | The independent regulator for POPIA and PAIA | Registers Information Officers, investigates complaints, issues enforcement notices and fines |
Some organisations call the Information Officer their POPIA compliance officer; what matters is registration. POPIA compliance registration means registering the Information Officer, and any deputies, with the Information Regulator through its eServices portal before they take up their duties (section 55). Above them, the governing body stays accountable: King IV Principle 12, and Principle 10 of its successor, King V, place the governance of information with the board, council or school governing body. A virtual CISO can support your Information Officer on the security side. A supplier's POPIA compliance letter is a statement, not a contract: where the supplier processes personal information for you, ask for the operator agreement too.

Your POPIA compliance framework
Regulation 4 of the POPIA regulations requires the Information Officer to ensure that a compliance framework is developed, implemented, monitored and maintained. A POPIA compliance framework template or toolkit gives you headings; the content must describe your own organisation. The framework we help you build contains:
A data inventory: what personal information you hold, where it lives (mailboxes, file shares, HR, payroll, finance, cloud applications, backups and paper) and who can see it.
A personal information impact assessment, also required by regulation 4.
A register of purposes, each with its lawful basis and retention period.
Notices and manuals: a privacy notice for each audience, the PAIA manual (PAIA sections 14 and 51) and the internal rulebook many organisations call a POPIA compliance manual.
A safeguards baseline mapped to section 19, and operator agreements with every supplier that processes personal information for you.
A security compromise plan for section 22 notifications, and a process for access, correction and deletion requests.
Training records for POPIA compliance training and the awareness sessions regulation 4 requires.
Together these form a data protection management system: registers, controls and reviews that make data protection management a monthly routine, not a one-off project. Our POPIA compliance checklist lists the evidence to keep for each item.
Security safeguards: where data protection meets cyber security
Data protection and cyber security meet in section 19. It requires appropriate, reasonable technical and organisational measures against the loss of, damage to or unauthorised destruction of personal information, and against unlawful access to it, with due regard to generally accepted information security practices. It also prescribes a method: identify the risks, establish safeguards, verify regularly that they work and update them as risks change.
Cyber data protection therefore starts with the controls attackers test first: multi-factor authentication and separate administrator accounts (Microsoft 365 security); protection against phishing and changed banking details (email security); patched, encrypted and managed devices; and backups that ransomware cannot reach (ransomware protection). "Verify regularly" is the step most often skipped, as licences lapse and exceptions become permanent, so we test the safeguards with a cybersecurity assessment and, where you need proof, a penetration test.

POPIA, GDPR and ISO standards: how they fit together
Buyers often ask for an ISO GDPR certification, or an ISO standard that covers POPIA. Neither exists: no ISO standard certifies compliance with POPIA or the EU's General Data Protection Regulation (GDPR), but ISO management-system standards give strong evidence of the safeguards both laws require.
| Framework | What it is | How it helps with POPIA |
|---|---|---|
| POPIA | South African law on personal information | The obligation itself |
| GDPR | The EU's data protection law, which applies when you process EU residents' data | Similar principles, so one programme can serve both |
| ISO/IEC 27001 | The certifiable standard for an information security management system | Evidence for section 19; usually what a buyer means by an ISO data protection standard |
| ISO/IEC 27701 | Requirements for a privacy information management system, built alongside ISO/IEC 27001 | Extends security controls to privacy: purposes, consent, retention and requests |
| NIST Cybersecurity Framework | A voluntary framework for managing cyber risk | A board-friendly structure for reporting on safeguards |
For ISO 27001 data protection work, the Annex A controls on privacy and personal information, information deletion, data masking and data leakage prevention map straight onto POPIA's conditions; see ISO 27001 readiness. Where GDPR applies too, record the differences, such as its 72-hour deadline for notifying the supervisory authority against POPIA's "as soon as reasonably possible".
Privacy by design: software, AI and Microsoft 365
GDPR Article 25 asks for data protection by design and by default, which is what GDPR for software developers means in practice, and POPIA leads to the same place: collect less, restrict access, encrypt, log and delete on schedule. Our custom software development team designs to those rules from the first specification.
- AI tools. An AI privacy policy generator can draft a notice in minutes, but it cannot know what you collect or where you store it, and a notice that misdescribes your processing breaches the openness condition, so check every line against your data inventory. When we build AI into your systems, data is minimised, encrypted and access-logged, and never used to train models without explicit consent; see AI governance.
- Microsoft 365 and Google Workspace. Microsoft POPIA compliance questions come up in every tenant review. Microsoft's data protection terms set out its duties as the provider, your operator under POPIA; your tenant's configuration remains yours. Sensitivity labels, data loss prevention, retention and Compliance Manager in Microsoft Purview are POPIA compliance software many organisations already license but have not switched on, and Google Workspace has data protection rules, Vault and sharing controls.

How we deliver POPIA compliance
01.
Scope
The entities, sites, systems and records in scope, and what is already in place.
02.
Map
We trace personal information across email, file shares, HR, payroll, finance, CRM, school or clinic systems, cloud applications and backups.
03.
Assess
A POPIA and security assessment against the eight conditions and section 19, each gap rated by risk.
04.
Remediate
Security fixes first, in order of risk; notices, policies and operator agreements drafted with your team. This is not legal advice: your attorneys confirm legal positions.
05.
Train and rehearse
Awareness for all staff and deeper sessions for HR, finance and IT through our security awareness training, plus a rehearsal of your compromise plan with our incident response team.
06.
Operate and review
For managed clients, monitoring checks each managed computer every 15 minutes and logs faults as tickets automatically, incidents are prioritised from P1 to P4 against targets agreed in your SLA, and each monthly service review reports on POPIA controls.
Non-compliance with POPIA: what is at stake
The Information Regulator can issue enforcement notices and administrative fines of up to R10 million (section 109); the most serious offences, including failing to comply with an enforcement notice, carry a fine, up to ten years' imprisonment or both (section 107); and people whose information is mishandled can sue for damages (section 99). In July 2023 the Regulator fined a national government department R5 million for failing to comply with an enforcement notice after a ransomware attack, having found that licences for key security software had lapsed (Information Regulator, July 2023).
Up to R10 million administrative fine (section 109)
Up to ten years' imprisonment for the most serious offences (section 107)
Eight conditions for lawful processing
Governance, procurement and continuity
Reporting. A POPIA section in your monthly service review (requests, incidents by priority, safeguards tested, operator agreements, open risks) and an annual summary for the board, council or governing body.
Public sector and schools. Public bodies hold citizens' information under PFMA or MFMA disciplines and PAIA; schools hold children's personal information, which POPIA protects more strictly (sections 34 and 35). See government cybersecurity and POPIA for schools.
Our own duties. When we manage your systems we process personal information for you: every remote session is approved and logged, and everyone with access is bound by confidentiality and our security controls. See our privacy notice and PAIA manual.
Procurement. Arke Technologies (Pty) Ltd is a Level 1 B-BBEE contributor (sworn affidavit available on request). Company documents, our CSD supplier number and SARS tax compliance status are available on request, and we complete SBD forms when a bid requires them; see company facts. Buy the assessment on a proposal and purchase order, or through your tender process.
Continuity. The inventory, registers, policies and evidence are yours, in editable formats, and you own your data, credentials and documentation. If your Information Officer changes, or you change provider, the framework hands over intact.
What POPIA compliance costs
Last reviewed: September 2026.
POPIA compliance costs fall into three lines: legal work on notices, policies and contracts; systems and security work; and your own people's time. The systems line depends on how many systems and sites hold personal information, how sensitive it is (health, children's and financial information raise the bar), how many operators you use, and how much of the protection you already license is switched on.
We quote the assessment and remediation per project, and ongoing managed security per user per month after the assessment. For context, published South African managed IT rates run from about R180 to R400 per user per month (matnet.co.za, September 2026).

Frequently asked questions
How do we become POPIA compliant? Show answer Hide answer
Register your Information Officer, map the personal information you hold, record a lawful basis and retention period for each purpose, and secure the systems that store it. Then sign operator agreements, publish notices and a PAIA manual, train staff and rehearse your breach plan. Most of the effort lies in the mapping and the safeguards, where we work alongside your team.
What are the 8 requirements of the POPI Act? Show answer Hide answer
The POPI Act's eight requirements, which it calls conditions for lawful processing, are accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards and data subject participation. Security safeguards, in sections 19 to 22, is usually the hardest to meet, because it needs technical controls, operator contracts and breach notification, not only policies.
Which parties must ensure compliance with POPIA? Show answer Hide answer
The responsible party, meaning the organisation that decides why and how personal information is processed, must ensure compliance, led by its registered Information Officer and overseen by its governing body. Operators that process information on its behalf must keep it secure and report compromises, staff must follow its rules, and the Information Regulator enforces the Act.
Is there a POPIA compliance certificate? Show answer Hide answer
No, the Information Regulator does not issue POPIA compliance certificates, and a certificate from a course or a consultant proves attendance or an opinion, not compliance. Compliance is shown by evidence: a registered Information Officer, a compliance framework, a data inventory, tested safeguards, operator agreements and records of requests and incidents.
What are some examples of POPIA violations? Show answer Hide answer
Typical POPIA violations include a shared folder of ID documents open to all staff, a client spreadsheet emailed to the wrong address, email marketing without consent, an unreported security compromise, records kept long after their purpose ends and a supplier with no operator agreement. Ordinary controls prevent most of them: access reviews, email rules, retention settings and a rehearsed breach plan.
What are the 7 types of privacy? Show answer Hide answer
The seven types of privacy most often cited come from a 2013 academic framework by Finn, Wright and Friedewald: privacy of the person, of behaviour and action, of communication, of data and image, of thoughts and feelings, of location and space, and of association. POPIA protects the information side: information relating to an identifiable, living person or an existing juristic person.
